Our Scope

Imagined Labs LLC ("us," "we", "our") want you to know how we collect, use, and disclose information from you in connection to any of our projects and services, including but not limited to OES NFT ownership. This Privacy Policy will outline our practices across all our services. By using our site/services, you agree to the terms and conditions of this Privacy Policy. We do not knowingly collect personal information from those under 18 years of age. Our Privacy Policy applies to all users and the collection/use of your personal information. 

These terms are subject to change; it is your responsibility to check this page regularly for updates. 

To conduct transactions or make purchases, you may need to provide us or our third-party payment processors with your payment information. We may ask you to connect your digital wallet via your public wallet address; however, we will not ask you to for/collect your private key(s). Payment card information entered is not stored but we may receive from third-party payment processing providers information associated with your payment card details.

In terms of OES (NFT),we do not control the blockchain protocol on which the OES and or other fungible/non-fungible tokens are used or traded, and we cannot control activity and data on any such protocol, the validation of transactions on the protocol, or use of said protocol.


Collection of Data 

We only collect minimal information that includes, but may not be limited to:

Your Contact Details

This allows us to directly identify and or contact you and may include your name, date of birth, address, e-mail address, telephone number, username, passwords, and gender. In addition, your electronic wallet address may be collected and shared, if necessary. 

Website Data

When you use our website, we may collect duration and time of the session, pages visited, transaction details, and technical info e.g., MAC address etc. 

Customer Care Information

This means information shared when you contact us enquiring about our website and or NFT service. In addition, your support requests and the details required to resolve them. You understand and agree that we may make a record of any issue(s). 



We may use information that we collect from you to provide our service(s) and associated features to you. You’ll agree these are necessary: 

  1. To complete all associated OES (NFT) transactions; 

  2. To enable us to respond to your queries effectively;

  3. To send you relevant content, information, marketing, and updates;

  4. To process orders through third-party affiliates;

  5. For taxation/ accountancy purposes; 

  6. To interact with Amazon SES;

  7. To allow you access and interact with our platform;

  8. To help us monitor and improve our services and quality assurances;

  9. To offer buyer protection;

  10. To allow social sharing functionality; and,

  11. To comply with legal obligations. 


We may disclose your personal information with:

  1. Third Party Websites/Applications such as electronic wallet extensions;

  2. Relevant blockchains and their administrators;

  3. Service providers such as IT hosting, support, customer and related services;

  4. Accountancy/taxation entities; 

  5. Our Webserver provider; 

  6. Third-party application program interfaces (“APIs”) and software development kits (“SDKs”);

  7. Google and or Google Analytics;

  8. Affiliates / Business-Partners. 


We may use the information from and about you to predict user’s interests. Of course, we may be required by law to retain or disclose your information to authorities, including law enforcement bodies. Also, we may retain or share information if we believe it is reasonably necessary to respond to a lawful legal request, protect rights, enforce terms and conditions of our service, the NFT marketplace, and or detect/prevent/investigate any illegal activity.

We will retain your information for the period necessary to fulfil the purposes outlined in this Privacy Policy unless a longer retention period is required or allowed by law.

Please note, even if you cancel your account or ask us to delete your personal information, some information from your account may remain viewable if you have shared information with social media or other services. 

If we are involved in an acquisition, merger, reorganisation, receivership, bankruptcy, or purchase/sale of assets, your information may be sold or transferred as part of such a transaction, as permitted by these terms and by law.

We may also backup your information on secure servers to comply with applicable law or internal security policies. It may not always be possible to completely delete all your information due to legal, technical, or contractual constraints.


User Access

You can access personal information we hold about you and or delete your information by emailing us here [email protected]. Please note we may ask you to verify your identity. If you wish to do so, please include your email address, name, address, and telephone number and specify clearly what information you would like to delete, access or update and we will try to comply with your request as soon as we can, pursuant to our obligations. 

You may request we not share your personal information with our affiliates or unaffiliated third parties. We will try to comply with your request as soon as we can, pursuant to our obligations. 

You may request a correction of your personal information if you believe same to be inaccurate.

Information processed by us may be processed, transferred, and or stored anywhere globally; where a jurisdiction may have data protection laws that are different from the laws where you live. We strive to safeguard your information pursuant to the requirements of applicable laws as set out herein.

While we strive to protect your information, this is not infallible. Therefore, you acknowledge and accept we cannot guarantee the security of your information; therefore, we disclaim any liability for unauthorised access/disclosure. If any breach occurs, we will email you if we become aware of said breach.

Links to third-party services are not controlled by us. We encourage our users to read the privacy policies of each website and application with which they interact. We are not responsible for the privacy policies of such other websites/applications. By providing personal information to third-party websites or applications, you do so at your own risk.

We are the data controller for the statutory purposes in data processing (which implements the European General Data Protection Regulation (Regulation (EU) 2016/679) [‘the GDPR’]). The categories of Personal Information that we collected/disclose is any identifier; personal information; personal information as listed within Californian Civil Code 1798.80(e); characteristics; commercial information; geolocation; internet activity; and inferences. Further, third-party personal information disclosed for business purposes may include blockchain networks; service providers; all third-party applications/interactions; and commercial information relation thereto. 

We do not sell information to any third parties. Please note that we may disclose some categories of Personal Information in connection with certain types of advertisements, which could be considered a "sale" under the CCPA.

You have the right to request that we delete Personal Information we collected from you.

You have the right to be free from unlawful discrimination for exercising your rights under the CCPA.

Please email us regarding the requests we received during the 2023 reporting period, or any year subsequent. California ‘Shine the Light’ law permits California resident users to request/obtain a list of the third parties to whom we have disclosed their personal information for their direct marketing purposes during the prior calendar year, as well as the type of personal information disclosed to those parties free of charge.
